Throughout these terms, "we", "us" and "our" mean Colorful Atelier. "You" means the person visiting the site or placing an order. "The site" means colorfulatelier.com and everything on it.

Accepting these terms

By visiting colorfulatelier.com, browsing it, or placing an order, you agree to everything set out below. These terms apply to every visitor and every customer, whether or not you buy anything. If you do not agree with any part of them, please do not use the site.

These terms sit alongside our Shipping Policy, our Refund & Return Policy and our Privacy Policy. Those three documents are part of this agreement, not separate from it. Where a specific policy covers a subject in more detail, that policy governs it.

Who can order

You must be at least 18 years old to order, or have the permission of a parent or legal guardian who accepts these terms on your behalf. By placing an order you confirm that you are old enough, that the details you give us are accurate and complete, and that you are legally able to enter into a contract with us.

You may not use our products or services for any unlawful purpose, and you may not break any law of your state or country in using them, including copyright law.

Where we sell

We sell and ship to addresses within the United States only. We do not currently ship internationally, and we do not deliver to freight forwarders. If you place an order for delivery outside the United States we will cancel it and refund you in full.

Our products

We sell lighting for the home: ceiling fixtures, pendants, flush and semi flush lights, and floor lamps.

Photography, screen calibration and the light in your own room all affect how color and finish come across. What arrives can differ slightly in shade, grain or sheen from what you saw on your screen. Rattan and other natural materials vary from one piece to the next, and small differences in weave, tone and texture are part of the character rather than a fault. Dimensions on a product page are approximate and can vary by a small margin.

Where a product page states that no bulb is included, no bulb is included. Where it states that the light source is built in, the fixture cannot be re-lamped and is not designed to be opened.

Electrical safety and installation

This matters more with lighting than with most products, so please read it.

Ceiling fixtures, pendants and flush mounts are hardwired. They must be installed in line with the National Electrical Code and any local codes that apply where you live. We recommend a licensed electrician. If you install a fixture yourself, you do so at your own risk, and we are not responsible for damage or injury that results from incorrect installation.

Do not exceed the maximum wattage stated for a socket. Use bulbs of the type and base listed on the product page. Our indoor fixtures are for dry indoor locations only and must not be used outdoors, in bathrooms, or anywhere they can be exposed to moisture, unless the product page says otherwise. Switch a fixture off and let it cool before cleaning it or changing a bulb.

Floor lamps plug into a standard US outlet. Do not run the cord under a rug, do not modify the plug, and do not use a damaged cord.

Availability

Everything on the site is subject to availability. We may limit or discontinue a product at any time, and we may limit the quantity of any item we sell to one person, one household or one order. If a piece turns out to be unavailable after you order, we contact you and either refund you in full or, if you agree, send an alternative.

Prices

All prices are shown in US dollars. Sales tax is calculated at checkout based on your delivery address and shown before you pay. Shipping within the United States is free, and any charge that does apply is shown at checkout before payment.

We may change prices at any time without notice, but a change never affects an order that has already been placed. If an item is listed at an obviously incorrect price because of a technical fault or human error, we may cancel the order and refund you in full rather than fulfill it. We tell you as soon as we notice.

Payment

We accept Visa, Mastercard, American Express, Discover, Shop Pay, Apple Pay and Google Pay. The icons in our footer show exactly what is available at checkout, and nothing more. Payment must clear in full before an order is dispatched.

Payments are processed by Shopify Payments and the wallet providers shown at checkout. We do not store full card numbers. If your payment is declined or reversed, we may cancel the order.

You agree to provide current, complete and accurate purchase and account information for every purchase, and to update your email address, card number and expiration date promptly so we can complete your order and reach you if we need to.

Discount codes and promotions

Discount codes are valid for the period stated, cannot be exchanged for cash, and cannot be combined with another offer unless we say so. One code per order. We may withdraw a promotion at any time, and we may cancel an order placed with a code that was obtained or used improperly.

How an order is formed

Your order is an offer to buy. The confirmation email means we received it, not that we accepted it. The contract between us exists once we dispatch the item and send you a shipping confirmation.

We may decline an order in whole or in part. Reasons include an item being unavailable, a price being wrong, an address we cannot deliver to, an order that looks like it is for resale, a payment we cannot verify, or a suspicion of fraud. If we decline your order, you get a full refund and we tell you why.

No resale

Our products are sold for personal use. You may not buy from us for the purpose of reselling, and we may refuse or cancel orders that appear to be placed for resale.

Cancelling or changing an order

You can cancel free of charge within 12 hours of ordering by emailing support@colorfulatelier.com with your order number. After that the order is usually already in processing and we cannot stop it, but you can still return it under our Refund & Return Policy.

We cannot change a delivery address once an order has been dispatched.

Shipping, delivery and risk

Delivery times shown on this site are estimates based on how our carriers normally perform, not guarantees. We are not responsible for delays caused by carriers, weather, customs, incorrect addresses, or other events outside our control. The full picture is in our Shipping Policy.

Risk of loss and damage passes to you when the carrier delivers the parcel to the address you gave us. Ownership passes to you once we have received payment in full.

Returns and refunds

Returns are handled under our Refund & Return Policy, which forms part of these terms. In short: 30 days from delivery, unused and in the original packaging, and we cover the cost when the fault is ours. The full conditions are in that policy.

Warranty

We warrant that our products arrive free of manufacturing defects. If a defect appears within 30 days of delivery, contact us with photos and we will replace the piece or refund you.

This warranty does not cover normal wear, damage from misuse or from an accident, damage caused by incorrect installation or wiring, damage from using the wrong bulb or exceeding the stated wattage, exposure to moisture or weather on a fixture meant for dry indoor use, modification of the product, or the ordinary variation you get in hand finished pieces.

Nothing in this section limits any right you have under applicable federal or state consumer protection law.

Accuracy of the information on this site

We do our best to keep everything on the site accurate and current, but we do not warrant that it is. Material on this site is provided for general information and should not be relied on as the sole basis for a decision. You use it at your own risk.

We are not obliged to update the site, though we often do. You agree that it is your responsibility to monitor changes.

Errors, inaccuracies and omissions

The site may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We may correct any of these, and may change or update information or cancel orders, at any time and without prior notice, including after you have submitted your order.

Changes to the site and to what we sell

Prices, products and the site itself can change without notice. We may modify or discontinue any part of the site at any time. We are not liable to you or to any third party for a change, a price change, a suspension or a discontinuation.

Using the site properly

You may not use this site or anything you buy from us:

• for any unlawful purpose, or to ask anyone else to do something unlawful
• to break any regulation, rule, law or local ordinance
• to infringe our intellectual property rights or anyone else's
• to harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate
• to submit false or misleading information
• to upload or transmit viruses or any other malicious code that could affect the site or anyone using it
• to collect or track the personal information of others
• to spam, phish, pretext, crawl, spider or scrape
• for any obscene or immoral purpose
• to interfere with or get around the security features of the site or any connected service

We may end your access to the site for breaking any of the above.

Intellectual property

The text, photography, illustration, layout, design, logo and wordmark on this site belong to Colorful Atelier or are used under license. You may not copy, reproduce, republish, distribute, or use them commercially without our written permission. Nothing on this site grants you a license to any trademark.

If you believe something on our site infringes your rights, email support@colorfulatelier.com and we will look into it and respond within 5 business days.

Content you send us

If you send us a review, a photo, a comment, an idea or a suggestion, whether we asked for it or not, you give us a non exclusive, royalty free, worldwide right to use, reproduce, edit, publish and display it in connection with our store.

You remain responsible for what you send. You confirm it is your own work, that it does not infringe anyone else's rights, and that it contains nothing unlawful, abusive or obscene. We are under no obligation to keep any submission confidential, to pay for it, or to respond to it. We may remove content at our discretion, and we may edit it for length or clarity.

Third party tools and links

We may give you access to third party tools that we neither monitor nor control. You use them at your own risk, as is and as available, and you should read the terms of the provider that supplies them.

Our site may link to pages we do not run. We are not responsible for their content, accuracy, or practices, and a link is not an endorsement. Complaints about a third party site go to that third party.

Your privacy

What we collect and what we do with it is set out in our Privacy Policy, which forms part of these terms.

Electronic communication

When you order from us or email us, you are communicating with us electronically. You agree to receive communications from us electronically, and you agree that emails, order confirmations and notices we send satisfy any legal requirement that a communication be in writing.

Disclaimer of warranties

We do not guarantee that your use of our site will be uninterrupted, timely, secure or error free. We do not warrant that the results you get from using it will be accurate or reliable, and we do not warrant that the site is free of viruses or other harmful components.

Except where stated above or required by law, our products and the site are provided as is and as available, without any warranty of any kind, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

Limitation of liability

To the fullest extent permitted by law, Colorful Atelier and its suppliers and service providers are not liable for any indirect, incidental, special, consequential or punitive damages, including lost profits, lost revenue, lost savings or lost data, arising from your use of the site or of any product bought through it.

Our total liability for any claim, whatever its basis, will not exceed the amount you paid for the item the claim relates to.

Some states do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you. In those states our liability is limited to the greatest extent the law allows.

Indemnification

You agree to indemnify and hold harmless Colorful Atelier, its officers, employees, suppliers and service providers from any claim or demand, including reasonable legal fees, made by a third party because of your breach of these terms, your breach of any document they incorporate, or your violation of any law or of the rights of a third party.

Events outside our control

We are not responsible for any failure or delay caused by events beyond our reasonable control, including natural disasters, extreme weather, fire, flood, strikes, labor disputes, war, terrorism, civil unrest, pandemics, carrier failures, power or network outages, and government action.

Resolving a problem

If something goes wrong, email us first at support@colorfulatelier.com. Most problems are solved in a day or two, and we would rather fix it than argue about it. Please give us 30 days to resolve a complaint informally before taking it further.

Governing law

These terms and any separate agreement by which we provide you products are governed by the laws of the State of Florida and of the United States, without regard to conflict of law rules. Any dispute that cannot be resolved informally will be handled by the state or federal courts located in Lee County, Florida.

None of this removes the protection of any mandatory consumer law that applies in the state where you live, or your right to bring a claim in small claims court.

If part of these terms does not hold

If any provision of these terms is found to be unlawful, void or unenforceable, that provision is enforceable to the fullest extent permitted by law, and the unenforceable portion is treated as severed. The rest of the terms stay in force.

Entire agreement

These terms, together with our Shipping Policy, Refund & Return Policy and Privacy Policy, and any policy or operating rule we post on this site, make up the whole agreement between you and us. They replace any earlier agreement or communication between us, spoken or written.

Our failure to exercise or enforce any right under these terms is not a waiver of that right.

Any ambiguity in these terms is not to be interpreted against us just because we drafted them.

Assignment

You may not transfer your rights or obligations under these terms to anyone else. We may transfer ours, for example if the business is sold, and your rights are not reduced by that.

Ending these terms

These terms remain in effect until either of us ends them. You can end them at any time by telling us you no longer wish to use our services, or simply by stopping using the site.

We may end them at any time, without notice, if you have breached them or if we suspect you have, and you remain liable for any amount owed up to that date. Sections that by their nature should survive, including intellectual property, disclaimers, limitation of liability, indemnification and governing law, continue to apply after these terms end.

Changes to these terms

We may update these terms at any time. The current version always sits on this page with the date at the top, and it is your responsibility to check it from time to time. Continuing to use the site after a change means you accept the change.
